A 2010 policy statement reiterates from Section 32-3-305 (m) and (n) of the West Virginia Securities Act that persons filing an amendment to Form NF, Uniform Investment Company Notice Filing Form, other than to increase the dollar amount of securities registered, must pay a $50 fee for each amended filing. An "amendment" is any change to Parts 1, 2, 4, 5 or 6 of Form NF whether or not the filer categorizes the change under "Amendments" or "Other" in Part 3 of Form NF. An amendment to Form NF must be filed at the time the amendment occurs. Amendments to Form NF filed simultaneously with the annual sales report filing are
not exempt from the fees.
