Nebraska Bill Requires its Professional Licensees to be U.S. Citizens or Legal Aliens

Bill No. 403 in the Nebraska legislature will require beginning October 1, 2009 that all state agencies in Nebraska verify the lawful presence of every individual receiving "public benefits" from a Nebraska state agency. Included in the definition of "public benefits" is a "professional license." As a result of LB 403, all broker-dealers will be required to verify and confirm that every new applicant for registration in Nebraska on or after October 1, 2009, is either a United States Citizen or qualified legal alien. Further, applicants identified as qualified legal aliens will be required to complete and remit at the time of application, a United States Citizenship Attestation Form ("USCAF") to the Nebraska Department of Banking and Finance.
